Jonathan Ishee is an associate in the Corporate Department of Seyfarth Shaw LLP’s Houston office.  He represents clients doing business within the healthcare and information technology industries and counsels clients on issues relating to regulatory, operational, and corporate matters.  In addition, he is an Assistant Professor at the University of Texas Health Science Center at Houston School of Biomedical Informatics and an Adjunct Professor at the University of Houston Law Center.  Jonathan also serves on various editorial boards including as an Associate Editor of the IEEE Journal of Translational Engineering in Health and Medicine.

Mr. Ishee’s experience includes serving as general counsel to multi-specialty physician groups and independent practice associations, where he provided legal and strategic business advice, and as a policy analyst in the United States Department of Health and Human Services Office of the National Coordinator for Health Information Technology. In this position, Jonathan was deeply involved in the Department’s efforts related to health information exchange, HITECH-mandated HIPAA modifications, development of regulations surrounding the EHR incentive program, and payment reform.  While at HHS, Jonathan’s was recognized by Secretaries Leavitt and Sebelius for his contributions.

Mr. Ishee’s principal area of practice focuses on transactional, regulatory, and administrative health law issues including HIPAA, EU privacy directives, managed care contracting, CMS and state insurance licensing, health information technology, health information exchanges, fraud and abuse issues including Stark and Anti-kickback, creation of health care joint ventures, and Accountable Care Organizations.

Representative Engagements

  • Drafted  participant agreements and management services agreements for private and state/federally  funded health information exchanges and drafted policies and procedures related to operation, patient authorization and consent.
  • Advised clients on the purchase of health information technology and the regulations surrounding Meaningful Use
  • Represented provider in the carve out and sale of a department to a hospital and its conversion to a hospital outpatient department (HOPD).
  • Advised clients on issues surrounding the Medicare Shared Savings Program and ACO Advance Payment program.
  • Advised clients on Medicare Advantage provider and marketing regulations and drafted Medicare Advantage facility and participant agreements.
  • Represented clients in administrative hearings including Recovery Audit Contractor determinations, and state department of insurance proceedings.
  • Advised client on issues surrounding HIPAA, 42 CFR Part 2, and state privacy laws.
  • Advised hospital client on issues surrounding state licensing and certificate of need requirements.
