Mr. Mirrafati is a senior associate in the Labor & Employment Practice Group of Seyfarth Shaw.  He represents management in all aspects of labor and employment law and litigation, including wrongful discharge, employment discrimination/retaliation, harassment, wage and hour matters, unfair competition, breach of employment contracts, proceedings before the National Labor Relations Board, as well as labor arbitrations.

In recent years, Mr. Mirrafati’s practice has taken a particular focus on management-side labor relations.  He has an extensive traditional labor background which includes handling over 35 labor arbitrations (both contract interpretation and discipline matters), 20 unfair labor practice charges, 4 election campaigns, and several hybrid wrongful termination/duty of fair representation cases.  Mr. Mirrafati has also assisted employers in collective bargaining negotiations and has personal relationships with the representatives and counsel for many unions and NLRB personnel.

Mr. Mirrafati also extensively counsels employers in various aspects of human resources and labor relations issues, including alternative dispute resolution and arbitration programs, wage and hour compliance, employment agreements, leaves of absence, personnel practices and policies, union avoidance, and union strike or picketing activity.  In addition, Mr. Mirrafati has advised corporations on the labor and employment aspects surrounding mergers and acquisitions.

Mr. Mirrafati represents clients that span a wide range of industries, including communications, hospitality, retail, pharmaceutical, finance, manufacturing, and education.

Prior to law school, Mr. Mirrafati founded and managed an elective surgery financing company. He was also a legal extern to the Honorable Robert Alberts, United States Bankruptcy Court for the Central District of California.

Mr. Mirrafati is also conversational in Farsi.

Wage & Hour Litigation

  • Obtained summary judgment and dismissals of four wage and hour class actions against a pharmaceutical company.
  • Obtained dismissals of two wage and hour class actions against a retail company through enforcement of arbitration program.
  • Preemptively moved to defeated class certification of 45,000 employees in wage and hour action against a restaurant chain.
  • Obtained favorable class-wide settlement for restaurant chain in wage and hour action involving 6,200 non-exempt restaurant workers.

Employment Litigation

  • Obtained summary judgment in favor of telecommunications company in a wrongful retaliatory discharge action.
  • Obtained summary judgment in favor of pharmaceutical company in a pregnancy discrimination action.
  • Obtained summary judgment in favor of staffing company in a sex discrimination action.
  • Obtained summary judgment in favor of public school in a disability discrimination action.
  • Obtained dismissal of a wrongful termination and duty of fair representation action against retail company.  
  • Obtained favorable settlement of a wrongful termination and duty of fair representation action against a grocery company.  
  • Obtained favorable settlement of a “failure to hire” age discrimination action against a school. 

Labor Arbitrations

  • Upheld the suspension/termination of over five employees for various vehicle accidents and/or violations of company safety policies.
  • Upheld the suspension/termination of over four employees for various actions involving mistreatment of customers.
  • Upheld the suspension/termination of over four employees for falsification of company records (i.e., time sheets, test results, or investigatory statements).
  • Upheld the termination of over three employees for adding products/services to customer accounts without consent. 
  • Upheld the termination of over two employees for attendance.
  • Upheld the termination of an employee for referring customers to a third-party vendor.
  • Upheld the suspension of an employee for insubordination and for improper assertion of Weingarten rights. 
  • Prevailed in a contract dispute involving the payment of personal holiday time at termination.
  • Prevailed in a contract dispute regarding the subcontracting of bargaining unit work. 

National Labor Relations Board Matters

  • Prevailed in two union election campaigns against distribution company and healthcare clinic.
  • Prevailed in a decertification election and successfully defeated all unfair labor practice charges and objections in connection with the same.
  • Obtained dismissals/withdrawals of over eight Section 8(a)(1) and 8(a)(5) charges for alleged unilateral implementation of changes to terms and conditions of employment against various hospitality and energy industry clients. 
  • Obtained dismissals/withdrawals of three Section 8(a)(1) and 8(a)(5) charges for alleged failure to provide information against various hospitality and telecommunications industry clients. 
  • Obtained dismissals/withdrawals of three Section 8(a)(1) charges for alleged threats/coercion and improper surveillance against various hospitability and healthcare industry clients.
  • Obtained dismissal of a Section 8(a)(3) and 8(a)(4) charge for alleged retaliatory termination.
  • Successfully dismissed or resolved numerous NLRB proceedings for Fortune 500 company.
