Maniya Gatmaitan is an associate in the Labor and Employment department of the Los Angeles office of Seyfarth Shaw LLP, where she represents and counsels employers on a wide range of employment matters. In the area of litigation, Ms. Gatmaitan has defended employers in matters involving wage and hour violations, wrongful discharge, discrimination, retaliation, and family and medical leave violations.  She has managed and driven single-plaintiff cases from start to finish, including formulating case strategy, taking and defending depositions of plaintiffs, expert witnesses, and third-party witnesses, representing clients in mediations and settlement conferences, drafting all pre-trial motions, and preparing for arbitration and trial.

Ms. Gatmaitan has extensive experience in defending against wage and hour class actions involving alleged meal and rest period violations, unpaid overtime, misclassification, failure to reimburse business expenses, gender discrimination, unlawful tip pooling practices, vacation and commission forfeiture and other alleged violations of state and federal law.  She has managed and driven evidence-gathering campaigns, conducted depositions of named plaintiffs and putative class members, obtained direct releases from class members, prepared exposure analyses and opposed class certification and merits-based discovery.

Ms. Gatmaitan has worked on numerous cases prosecuting and defending alleged trade secret misappropriation, breaches of restrictive covenants and employee disloyalty.  In one case involving employee disloyalty, Ms. Gatmaitan second chaired an arbitration for a health care client that won a substantial monetary award against a former employee and competitor corporation.  Her role as second chair included examining key witnesses, preparing defense witnesses for testimony, and preparing key briefs and exhibits. In another case involving employee raiding and other acts of unfair competition, Ms. Gatmaitan was a member of a trial team that won a multi-million dollar jury verdict for the client title company.

In addition to litigation, Ms. Gatmaitan provides advice and counsel to clients on personnel issues.   She has prepared or revised employee handbooks in accordance with state and federal law.

Representative Engagements

Representative Wage and Hour Class Actions

  • OSF International Inc. adv. Janik (defended a restaurant chain against class claims alleging unlawful tip pooling practices - successfully challenged the legal basis for the claims in the complaint and obtained complete dismissal of class action complaint with prejudice at the outset of the case)
  • Represented a global air cargo carrier in a wage and hour class action alleging unpaid regular and double overtime and meal and rest break violations.  Obtained direct releases from a majority of the class members, which resulted in dismissal with prejudice of the named plaintiffs’ class claims.   
  • Represented a satellite television installation provider in a wage and hour class action in state court brought by independent contractors alleging that they were misclassified as independent contractors and denied proper overtime pay and meal and rest breaks.  
  • Represented a national restaurant chain in a wage and hour action in Los Angeles County Superior Court brought by non-exempt employees alleging that they were denied meal and rest breaks and overtime pay.
