Neal Goldstein is a partner in the Healthcare Practice Group of the Corporate Department of Seyfarth Shaw LLP.  He is also the Chicago Office Chair of the firm’s Corporate Department.  Mr. Goldstein serves as outside general counsel and regulatory counsel for health care providers and companies which do business with providers.

Mr. Goldstein started out his professional career as a Certified Public Accountant in the audit department of the accounting firm of Altschuler, Melvoin & Glasser (now part of McGladrey).  During his 2 years as an auditor, Mr. Goldstein developed certain analytical skills which have proven invaluable in helping clients sort out complicated facts and navigate through complex fraud and abuse laws.

Upon graduating from law school in 1989, Mr. Goldstein was hired as a real estate associate with the Chicago-based law firm of Rosenthal & Schanfield.  Over the next several years, Mr. Goldstein’s practice expanded to include corporate law and trust and estates law.

One of Mr. Goldstein’s first clients was a group of four orthopaedic surgeons who were forming a medical practice.  Mr. Goldstein represented those surgeons in the formation of what is now known as Illinois Bone and Joint Institute.  Since its inception in 1991, Mr. Goldstein has been the primary outside counsel for Illinois Bone and Joint Institute.

In 2002, Mr. Goldstein began guest lecturing, at Loyola Law School of Chicago’s Health Law Institute, on the Federal Stark Law and the Federal Anti-Kickback Statute.  This led to Mr. Goldstein developing a course devoted specifically to Stark, which he has taught at Loyola Law School since 2008.  It is the only course of its kind among law schools in the Midwest.  Developing and teaching a course on Stark gives Mr. Goldstein unique and in-depth expertise on a law which has broad applicability to the provider community.

Mr. Goldstein has been on the Board of Directors of Sinai Health System, which is the parent organization of Mt. Sinai Hospital and Schwab Rehabilitation Hospital, since 2005.  He currently sits on the Executive Committee of the organization, and is Chairman of the Quality Committee for the hospitals.  Being a hospital board member and chairing a quality committee provides Mr. Goldstein with powerful insights into hospital governance, physician-hospital relations, and a myriad of other issues affecting providers.  He also has gained a keen perspective on the Affordable Care Act, with Mt. Sinai and Schwab being on the front lines of healthcare reform.

As a healthcare attorney, Mr. Goldstein regularly counsels providers on Stark, Anti-Kickback and compliance issues.  He has represented clients in government investigations, RAC audits, ZPIC appeals, and with respect to self-disclosure issues.  Mr. Goldstein has advised numerous clients on corporate structure and governance issues, in particular as it relates to the “Group Practice” standards under Stark.  He has represented several large single-specialty group practices in their formation and, as part of that representation, has been involved in many M&A and joint venture transactions.

Mr. Goldstein was recognized by Nightingale’s Healthcare News in 2006 and 2007 as one of the country’s “Outstanding Physician Practice Lawyers.”  He is AV® Peer Review Rated by Martindale-Hubbell.
