Robert (RJ) Wood is an associate in the Real Estate Practice Group in the Sacramento office of Seyfarth Shaw LLP.  His versatile practice is dedicated to the representation of creditors in loan enforcement litigation, workouts, restructurings, bankruptcies and transactions involving the disposition of real estate and personal property collateral.  Mr. Wood advises lenders on complex matters involving a broad range of issues, including title and insurance disputes affecting real property, California's foreclosure and anti-deficiency laws, receiverships, structured (CMBS) and participated loans, bankruptcy reorganizations, UCC issues and the defense of "lender liability" and other business tort claims.  He has particular expertise in utilizing judicial and extra-judicial strategies to identify and prevent the dissipation of assets, improve clients' positions vis-à-vis competing creditors and maximize recovery in workouts and bankruptcy.

Mr. Wood is an experienced litigator with significant jury trial experience.  He has successfully obtained pre-judgment orders of attachment, injunctions and writs of possession in complex commercial cases and has prosecuted several actions to judgment.  Mr. Wood is equally adept at enforcing and collecting judgments and negotiating forbearance agreements, short sales, note sales and refinancing transactions.  He brings his litigation experience and instincts to the table in transactional matters and delivers an efficient and focused representation of lenders in the litigation arena.

Representative Engagements

  • Represented major national bank in connection with enforcement and recovery of defaulted floor plan and real estate loans totaling over $120 million from an array of failed auto, marine and RV dealers throughout California.
  • Advised bank regarding bankruptcy issues, title disputes, environmental hazards, restrictive covenants, liens and assessments in connection with repossession and disposition of commercial buildings in Pittsburg, CA.
  • Represented bank in negotiation and documentation of refinancing by third-party lender of floor plan loans cross-collateralized with performing real estate loans.
  • Obtained cure of loan defaults for lender client and consensual pledge of additional collateral to secure deficiency after filing suit and seeking writ of attachment against guarantors of construction/development loan in Sonoma County.
