Mr. Bazarian is a Senior Counsel in the Litigation Department of the Boston office. His practice focuses primarily on complex business and commercial litigation, product liability and other tort litigation, and large scale debt collection and other creditors’ rights actions. He is an active member of the Firm’s Product Liability and Toxic Torts practice groups. Mr. Bazarian’s clients include Whole Foods Market, for whom he is lead defense counsel for all of the company’s general liability cases in New England, including claims related to Foodborne illnesses and premises liability. Before coming to the firm, Mr. Bazarian successfully ran his own law office for 8 years. Mr. Bazarian’s extensive experience enables him to advise a wide range of clients with regard to potential disputes and to represent those clients through litigation, at trial, and in appeal. He has obtained successful results for numerous clients in the technology, manufacturing, pharmaceutical, real estate, insurance, financial, and banking industries. Mr. Bazarian is also an Adjunct Professor at Boston College Law School.

  • Conklin, et al. v. Perdue, et al. (Suffolk County Superior Court, Mass. 2002) (obtained defense verdict for corporation and its president after 7-day trial where plaintiff brought claims of usurpation of corporate opportunity and breach of fiduciary duties and alleged damages of $28,000,000).
  • Claims of Margot Standish (Connecticut 2010)(on behalf of national grocery chain, successfully mediated pre-litigation claims of minor child who alleged catastrophic injuries as a result of consumption of milk allegedly contaminated by E. coli).
  • Claims of Kaylee Prue (Connecticut 2011)(on behalf of national grocery chain, successfully mediated pre-litigation claims of adult woman who alleged catastrophic injuries as a result of consumption of milk allegedly contaminated by E. coli).
  • 2008 Ground Beef-Related E. coli O157 Outbreak. Defended national grocery chain against claims of approximately 42 individuals alleging injuries in multi-state ground beef-related E. coli O157:H7 outbreak and successfully negotiated settlement of all claims between client and its ground beef manufacturers and suppliers.
  • First Trade Union Bank v. 166 Pine Realty Trust, et al. (Suffolk County Superior Court, Mass. 2010)(obtained summary judgment for bank on all claims in collection action on 8 promissory notes with a principal amount exceeding $3.5mm).
  • Gifford v. Middleby Marshall, Inc., et al. (Middlesex County Superior Court, Mass. 2004)(obtained summary judgment for defendant oven manufacturers in asbestos personal injury action).
  • Kerrigan v. Middleby Marshall, Inc., et al. (Middlesex County Superior Court, Mass. 2004)(obtained summary judgment for defendant oven manufacturers in asbestos personal injury action).
  • RBS Citizens, National Association, as successor by merger to Citizens Bank of Massachusetts v. Witsop-1, LLC, et al. (Suffolk County Superior Court, Mass. 2011)(obtained summary judgment in the amount of $3.4mm for bank in collection action).
  • RREEF America REIT III-Z1 LLC v. Inforonics Global Services, LLC, et al. (Middlesex County Superior Court, Mass. 2011)(obtained substantial settlement for plaintiff landlord in dispute with tenant after obtaining temporary restraining order freezing tenant’s assets and initiating eviction action)
  • Acquiport Unicorn, Inc. v. Dynabazaar, Inc. f/k/a FairMarket, Inc. (Suffolk County Superior Court, Mass. 2004)(obtained a seven-figure settlement for plaintiff landlord in dispute with tenant after obtaining a temporary restraining order freezing defendant’s assets and attaching $1,000,000 in defendant’s bank account).
  • Cardinal Health 106, Inc., et al. v. McClelland Drug Store and Health Systems, Inc., et al. (Berkshire County Superior Court, Mass. 2003)(obtained a temporary restraining order freezing defendant’s assets, attachment of $900,000 in tenant’s bank account, and real estate attachment in large scale creditor’s rights action).
  • Mass. Commissioner of Revenue v. Johnston (Suffolk County Superior Court, Mass. 2004)(defeated Commissioner of Revenue’s motion for summary judgment against defendant in multi-million dollar tax liability action).
  • Lapides v. TSCentral, Inc. (Norfolk County Superior Court, Mass. 2001)(defeated preliminary injunction which would have prevented client from conveying substantial assets and obtained dissolution of attachment of client’s bank account).
  • ChooseEnergy.com, Inc. v. Whatman, Inc. (Middlesex County Superior Court, Mass. 2001)(obtained temporary restraining order enjoining defendant from denying client access to rented premises where it stored substantial proprietary information).
  • Eagle Bank v. Northeast Freight Systems, Inc., et al. (Middlesex County Superior Court, Mass. 2005)(obtained summary judgment in large scale creditor’s rights action in an amount exceeding $500,000).
