Seyfarth Partner David Bizar is moderating a panel on Saturday, April 8, 2017 at the American Bar Association Business Law Section’s 2017 Spring Meeting, taking place in New Orleans, LA.  David’s session is entitled  “The New Proportionality Standard for Federal Court Discovery: Financial Institution and Consumer Advocates Weigh In.”
 
The session will provide how the new federal proportionality standard under Federal Rule of Civil Procedure 26 is already impacting and will continue to change the burdensomeness of discovery on consumer financial services companies.  The new rule injects a sliding scale of proportionality which was actually intended to help businesses with affording them the opportunity to object that the discovery sought “is relevant to any party’s claim or defense and proportional to the needs of the case, considering the importance of the issues at stake in the action, the amount in controversy, the parties’ relative access to relevant information, the parties’ resources, the importance of the discovery in resolving the issues, and whether the burden or expense of the proposed discovery outweighs its likely benefit.”  Fed. R. Civ. Pro. 26(b)(1).
