This program will focus on the complex challenges faced by employers due to statutory and legal developments related to Family Responsibilities Discrimination (“FRD”). The program will address strategies for maintaining morale and productivity, while ensuring compliance with a range of statutes designed to facilitate leaves of absence for tending to familial obligations. We will review evolving employer duties and potential risks associated with employees exercising rights to fulfill family responsibilities outside of work; and, suggest practical ways for employers to address these issues. Highlights of this briefing include:

  • Discussion of the challenges faced by employees and employers regarding the
    provision of child care and elder care services;
  • Review of the development of FRD claims and their interrelationship among the
    FMLA, CFRA and other statutory leave provisions;
  • Analysis of the legal themes and related issues involved in FRD claims such as
    stereotyping, “sex-plus” disparate treatment, retaliation, and hostile work
    environment; and,
  • Strategic and proactive approaches to address these issues.
     

This program will assist employers to balance their employees’ legitimate interests
in tending to familial obligations with the employers’ interests in controlling abuse,
promoting morale, and maintaining productivity. We encourage our guests to bring their
