Joseph Breen will present The Changing Law of Disability at the 2008 NCHRA 24th Annual HR West Conference.

Objective:

Remain in compliance with reasonable accommodation requirements by learning important developments in the courts and the legislature affecting disability rights in the workplace.

Workplace disability issues are very fact specific. Human resources professionals must consider a number of overlapping laws concerning disability. Among the most challenging: the Americans with Disabilities Act (ADA) at the federal level, California’s Fair Employment and Housing Act (FEHA), worker’s compensation statutes, and in some cases even the Health and Safety Code. Additionally, the proposed ADA Restoration Act and recent court cases in California addressing light-duty programs, the rights of hearing-impaired drivers, and medicinal marijuana use emphasize the need for employers in all industries to assess their policies and procedures to remain compliant with current laws.
