On October 2nd, the National Labor Relations Board issued three decisions addressing supervisory status of individuals who do not have the authority to hire, fire or discipline employees. These decisions, interpreting the U.S. Supreme Court’s decision in Kentucky River, provide important guideposts for employers looking to determine who is a supervisor in the 21st century workforce.
