This program will examine the practical implications of the amendments, a number of which are significant and may require changes in our standard litigation and eDiscovery practices. Chief among these are the revisions to Rule 34, which is set to require increased specificity for objections and a statement describing any documents withheld from production. Other big ticket changes include those to Rule 26, affecting the scope of what is discoverable, and Rule 37(e), which completely replaces the current ineffectual safe harbor provision for loss of electronically stored information with a uniform standard for preservation failures.
