Recruiting and hiring former Government employees and military personnel have always offered unique risks, including civil and criminal prosecutions, but recent regulatory changes have upped the ante. In addition to the long-standing proscriptions of 18 U.S.C. 207 and the Procurement Integrity Act, the Ethics Pledge (for political appointees), FAA regulations, and new DFARS requirements have added compliance elements. For example, did you know that anyone bidding on a DoD contract must certify that all of their employees and consultants who are “covered DoD officials” are in compliance with their post-employment restrictions?
The presentation will address:
- The rules, including recent revisions, and best practices to allow companies to maximize the strategic value of their hires while complying with the various restrictions and preserving their ability to participate in future procurements.
- Recent updates involving the Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) that every government contractor needs to know.
