Biography
Commercial Litigation - Franchise and distributorship litigation: representation of plaintiffs and defendants in nearly all forms of franchise and distributorship disputes including antitrust claims, state franchise claims, violation of Little FTC Acts, contract claims, estoppel, commercial torts and discriminatory practices; shareholder derivative suits; fraud claims; disputes for and against manufacturers’ representatives; covenants not to compete; contract and warranty disputes; civil RICO; mobile home park disputes; computer software and hardware disputes; government contract litigation including claims litigation before the Armed Services Board of Contract Appeals and bid protest litigation before the General Services Board of Contract Appeals; trademark and unfair competition claims.
Litigation defense and claim work involving individual and class actions, jury, bench and appellate practice.
Antitrust - Representation of plaintiffs and defendants in civil litigation under federal and state antitrust laws including actions for restraint of trade, monopolization, unlawful mergers or acquisitions and price discrimination. Providing advice, memoranda and opinion letters involving the antitrust implications of myriad commercial practices including distributor terminations, distribution practices and conversion of distribution systems; pricing practices; labor/antitrust issues; mergers and acquisitions; and association practices.
Nontraditional Workforce - Representation of corporate clients in connection with their use of nontraditional workers such as independent contractors and leased employees, and in connection with the defense of claims brought by plaintiffs and agencies challenging the nonemployee status of such workers; serve as Co-chair of firm’s Non-Traditional Workforce Task Force.
