Biography
Mr. Yu is an associate with the Litigation Practice Group, focusing primarily on commercial litigation, trade secret litigation and product liability defense. He has experience representing clients in a diverse range of matters, including complex contract disputes, toxic tort litigation, trade secret misappropriation, franchise disputes, employment litigation, business torts, and consumer fraud. He regularly practices in the federal and state courts of New York and New Jersey.
As a member of the firm’s Products Liability group, Mr. Yu has substantial experience defending manufacturers against claims of injury or fear of injury caused by exposure to asbestos-containing products and various dioxin-related chemical compounds. Most recently, he assisted with the defense of a manufacturer of Agent Orange in a lawsuit brought against it and other manufacturers by various U.S. veterans of the Vietnam War and/or their surviving family members, individually and, in some cases, on behalf of a putative class of similarly situated plaintiffs, alleging strict products liability in tort, design defect, manufacturing defect, and failure to warn, among other claims. He is a member of the team that prepared the defendants’ motion for summary judgment based on the government contractor defense, which succeeded in obtaining a complete dismissal of plaintiffs’ claims.
Mr. Yu is also a member of the firm’s Trade Secrets group. He has successfully obtained restraining orders and injunctions against former employees and competitors for theft of confidential/proprietary information and/or breach of restrictive covenants on behalf of several clients involved in various industries, including sales, actuarial services and the personnel placement industry. Likewise, he has defended individuals against claims brought by their former employers for alleged misappropriation and unfair competition.
Mr. Yu also has also defended several class action lawsuits, including wage and hour class and collective actions. Notably, he helped obtain the dismissal of a putative class action claim brought against a major insurance company by a medical health provider, alleging damages for late payment of medical benefits in violation of New York’s Insurance Law and New York’s consumer fraud statute.
From 2000 to 2001, Mr. Yu served as a law clerk to the Honorable Ariel A. Rodriguez of the Superior Court of New Jersey, Appellate Division.
