Biography

A partner in the Construction Practice Group of Seyfarth Shaw LLP, Mr. Bergin has been practicing construction law exclusively since 1999. Prior to focusing on construction, his practice included not only construction but other aspects of commercial litigation that required more than fifty trials in state and federal courts, as well appellate arguments in Maryland and Virginia.

Mr. Bergin currently represents owners, developers, general contractors, subcontractors, and design professionals in all aspects of construction. His experience includes drafting and negotiating contracts for a wide range of projects, as well as counseling clients on related insurance and bonding issues. During construction, Mr. Bergin assists clients in documenting and protecting their interests on issues that may arise so that they may attempt to resolve them during construction and, if not, will have protected their interests. Mr. Bergin then assists his clients with any remaining issues as cost-effectively as possible, including resolving claims directly with other entities, drafting claims and requests for equitable adjustment, and successfully mediating disputes before the clients incur the substantial costs required to fully litigate matters. When necessary, he represents his clients in state and federal courts, as well as arbitration, four of which have culminated in multi-week hearings. He also drafted an appellate brief in a significant matter before the Second Circuit that the parties resolved prior to oral argument.

Mr. Bergin has represented clients in a number of private and public construction projects, including a Major League Baseball Stadium, a National Football League Stadium, power plants, schools, office buildings, underground fiber-optic construction, a mixed-use apartment building, condominiums, as well as Government facilities and infrastructure projects both in the United States and abroad.
