• Successfully mediated settlement whereby owner’s default termination of contractor client was converted to a termination for convenience, and client was reimbursed in excess of $8 million.
• Achieved a defense verdict for an owner against a contractor’s claim for additional costs in the construction of an office/retail complex.
• Successfully defended a design professional client in litigation against a $15 million claim filed by a prime contractor on a performing arts center, resulting in a mediated settlement of substantially less than the client’s anticipated costs of defense.
• Developed library of standard contract documents for use by contractor client.
• Drafted and negotiated the design-build construction management agreement for the renovation of three buildings within the school of music of a major urban university under a fast-track contract.
• Successfully mediated contractor client’s multi-million dollar recovery for extra work, delays and impact costs against owner and design professionals in connection with the construction of two science and engineering buildings at a regional university.
• Favorably resolved at mediation the contractor’s claim for extra work required in the environmental clean up of a Superfund site.
• Defeated a claim for breach of a literary contract in arbitration.
