Representative Engagements

  • Evans v. URS Corporation et al., Alameda County Superior Court. Defended corporation and manager against race discrimination, harassment and retaliation claims. Case settled after defense rulings on most motions in limine. (2004)
  • Hobbs v. URS Corporation et al, San Francisco Superior Court.  Defended employer and Senior Vice President in five week jury trial against sex and age discrimination, retaliation and related claims.  Defense verdict (2003).
  • Smith v. Langton, Guardian Life Insurance Company of America, et al., San Francisco Superior Court No. 310626.  Defended three defendants against theft of trade secrets, unfair competition, breach of contract and related tort claims in five week jury trial.  Defense verdicts on 13 of 14 claims.  Nuisance value award on 14th.  (2002)
  • Chubb & Son v. McDermott, Contra Costa Superior Court.  Represented employer in obtaining injunction under California’s workplace violence statute against threatening employee.  Result upheld on appeal.  (2001)
  • Morganthaler v. Buffington, Santa Clara Superior Court No. CV 747862.  Represented defendants in suit alleging breach of contract, trade secrets theft, conspiracy and fraud in a nine day jury trial.  Defense verdict on 8 out of 9 claims (1997).
  • Moore v. RHH, Fresno Superior Court.  Represented defendant insurance broker in defense of wrongful termination case in four and one half week jury trial.  Defense verdict (1995).
  • Sullivan v. Delta Air Lines, Inc., San Mateo County Superior Court.  Represented Delta Air Lines in a seven week jury trial defending Delta against claims of HIV discrimination, invasion of privacy and related torts.  This is the first HIV discrimination case tried to a jury through to a verdict in the country.  Defense verdict on all discrimination claims (1994).
  • Represented Westamerica Bank in companion cases Westamerica v. Kirkpatrick, Sacramento Superior Court No. 95-AS-06309, an action by lender to reform loan documents due to mistake, and Kirkpatrick v. Westamerica, Sacramento Superior Court No. 97-AS-00839, a case involving alleged lender statutory violations.  Successfully concluded one case on summary judgment and tried the other to the court for twelve days (1998).
