“Employee Class Actions Still on the Rise”
Jerry Maatman was quoted in the article, “Employee Class Actions Still on the Rise,” published in the February 11, 2008 issue of National Underwriter. The article reports on the findings in Seyfarth Shaw’s Fourth Annual Workplace Class Action Litigation Report.
Jerry notes, “The class-action cases decided in 2007 foreshadow the direction of complex litigation against employers in the coming year.” He further states that, “Private plaintiffs’ lawyers and government enforcement attorneys are apt to be equally, if not more aggressive in 2008 in bringing class-action and collective action litigation against employers.”
The article goes on to note the highlights of the Annual Workplace Class Action Litigation Report, including: the volume of wage-and-hour litigation is increasing exponentially, the Class Action Fairness Act of 2005 continued to have significant effects on workplace litigation, the financial stakes of workplace class actions increased again in 2007, and plaintiffs’ lawyers have resorted to state court forums more frequently to pursue employment-related class actions.
