Steven Pearlman was quoted in the October 2, 2008 Business & Legal Report's HR.BLR.com article, "ADA Discrimination Lawsuits to Rise Dramatically, Lawyer Predicts." The article reported on likely increase in lawsuits following the passage of the Americans with Disabilities Act Amendments Act. In the article, Steve advised employers to "stop focusing on the question…and change your mentality. You should try to make the reasonable accommodation." According to Steve, to deny an accommodation, employers have to show that accommodation "unduly" costs money or disrupts operations. In practice, courts take a fairly hard line. Because of the risks involved, employers are better served by starting with trying to make the accommodation, as opposed to relying on the "undue hardship" provision.
