Client Prevails in a Wage and Hour Denial of Overtime Class Action Lawsuit

A team of attorneys from our labor and employment practice represented the defense in Carletto, et al. v. Quantum Foods, et al., a wage and hour denial of overtime class action lawsuit filed in the Circuit Court of Cook County, Illinois. Plaintiffs' counsel claimed that our clients violated the Illinois Wage Payment & Collection Act and the Illinois Minimum Wage Act in failing to pay for time spent donning and doffing safety equipment by employees. The class numbered approximately 1,000 employees.

Judge Thomas Quinn of the Circuit Court of Cook County granted our motion to dismiss the class action lawsuit on preemption grounds. The lawsuit is a high profile case in the Chicago-area, which involves a large meat processing plant, and thus, is being closely watched by many other manufacturers.
