Marshall Babson was quoted in an October 7 story “Judges' Rebukes Won't Make NLRB Abandon 'Nonacquiescence'” in Law360 on the D.C. Circuit’s recent stinging criticism of the National Labor Relations Board for its tendency to ignore court decisions that the board doesn’t agree with highlights frustrations felt by courts around the country. Babson said that if the NLRA were to acquiesce in a particular circuit, it would prevent the agency from having the chance to press its view with regard to the proper interpretation of the statute.
