Marshall Babson quoted in Corporate Counsel, “NLRB 'Purple' Ruling May Leave Employers Feeling Blue”

Marshall Babson was quoted in a December 15 story from Corporate Counsel on a long-awaited and significant National Labor Relations Board (NLRB) ruling which upends prior NLRB thinking on worker use of employer email. Babson explained that meeting the standard for proving that a nonwork email ban is necessary for production or discipline would be difficult to meet, so it’s unlikely employers will be able to use a ban to get out of complying with the board’s decision.
