Seyfarth’s Marshall Babson to Testify Before Senate HELP Committee on NLRB’s Proposed Joint Employer Standard

On Thursday, February 5, Seyfarth Shaw’s Marshall Babson will testify before the U.S. Senate Committee on Health, Education, Labor & Pensions (HELP) in a full Committee hearing on the National Labor Relations Board (NLRB) proposed new joint employer standard. The HELP Committee hearing, “Who’s the Boss? The ‘Joint Employer’ Standard and Business Ownership,” is scheduled to begin at 10 a.m. ET and more details can be found here.
 
Appointed by President Reagan in 1985, Babson was confirmed by Congress and served on the NLRB until 1988. While on the NLRB, Babson participated in a number of significant decisions, including, e.g., John Deklewa & Sons, which set forth new rules for pre-hire agreements in the construction industry, Indiana and Michigan Electric Co., which established guidelines regarding an employer’s duty to arbitrate post-contract expiration grievances, and Fairmont Hotel, a union access case which involved clarifying the balance between private property rights and Section 7 rights under the National Labor Relations Act.
 
Babson’s written testimony will be available on Seyfarth’s website, as well as the HELP website on Thursday, February 5. The Senate testimony was drafted with the assistance of Seyfarth’s Camille Olson, Gerald Maatman, Larry Lorber, David Ross, Gena Usenheimer and Jade Wallace.
