Seyfarth Shaw Real Estate partner Ira Fierstein wrote an article published in the September issue of Law Journal Newsletter's (LJN) Commercial Leasing Law & Strategy. The article offers advice to tenant clients when facing relocation in office or retail leases, and Ira expands on how they should handle issues such as timing, the nature of substituted premises, the landlord's payment obligations, no additional cost to the tenant and the right to terminate.
Ira also points out additional considerations that retail tenants should keep in mind, in order to ensure a smooth transition, minimizing interruption of the business' operations.
While each tenant's circumstance is different, Ira emphasizes that it is important to consider the where, when and cost of relocation. He says, "Answers to these questions will determine the extent to which a tenant will willingly go along with its landlord's offer, or negotiate vehemently for alternative solutions.
