Seyfarth's comments were published in a September 26 story from Law360, "OT Rule Comments Show Sharp Divide On Salary Threshold." Seyfarth said that establishing different salary levels based on geographic area, employer size or industry would also require the DOL to set rules for assessing when an employer or employee is working in a particular geographic area or industry, or how employer size should be determined.
