In June, the U.S. Department of Labor’s Wage & Hour Division announced its long-awaited proposal to amend 29 CFR Part 541, the “white collar” exemption for executive, administrative, and professional employees. If implemented, this proposal would increase the salary levels required for the exemption and the highly compensated exemption -- more than doubling the standard salary from $455 to an estimated $970 per week ($50,440 per year) in 2016 and increasing the highly-compensated salary requirement to $122,148 per year. Under the DOL’s proposal, this amount would be subject to automatic annual increases based on alternate indexing methodologies discussed in the proposal.  The Department’s proposal also leaves open the possibility of significant changes to the exempt duties test.
