 Since 2007, Seyfarth Shaw's Advanced Labor and Employment Law Conference has provided a unique opportunity for labor and employment thought leaders to discuss significant developments impacting California employers.  This year will be no exception.  We are extremely excited about our program this year and hope you can join us!

Panel Topics Slated for this Conference Include:

  • Contingent Workforce Issues—When Does a Worker Become Your Employee?
    This panel will discuss joint employment, independent contractors, temporary employees, unpaid interns and other contingent workforce issues.  Subject-matter experts will explore the many different tests for determining if a worker is your employee, best practices and practical tips for avoiding liability, and the wide-ranging ramifications of misclassification, including newly enacted Labor Code section 226.8.
  • Data-Privacy Issues (Both Domestic and International)
    The panel will provide an overview of various employment-related data-privacy requirements and compliance strategies, both in the United States and abroad.  The discussion will also address recent developments in the enforcement of data-privacy laws.
  • Wage-and-Hour Law: What's New for 2012 and What Issues Remain Hot
    This panel will discuss best practices, strategies, and alternative approaches for employers in the management and defense of wage-and-hour class action litigation.  Wage-and-hour thought leaders will share their ideas and experiences regarding cutting-edge strategies for defeating class certification, litigation management, as well as budgeting and expense control.  The panel will review Brinker and several subsequent Court of Appeal cases applying and interpreting Brinker.  Other topics include California and federal overtime exemptions, the increasing scrutiny given to class action settlements, and arbitration agreements.
  • Ethics Issues in the Workplace 
    This panel is comprised of in-house compliance and labor and employment attorneys from two of the Bay Area’s leading companies, as well as Seyfarth’s General Counsel.  This ethics discussion will include topics such as the ability to co-opt opposing counsel in settlement negotiations, transparency in the sourcing of human capital, and new federal government directives regulating the manner of internal investigations.   

Breakout Sessions:  In addition to the topics above, the conference will include breakout sessions covering recent developments in the Patient Protection and Affordable Care Act (PPACA), the National Labor Relations Board (NLRB), and business immigration.
