The ADA was amended in 2009 to increase the types of medical and psychological conditions covered by the Act. One of the most difficult requirements under the ADA is the obligation to provide "reasonable accommodations" to disabled employees. Public sector employers tend to have additional concerns in this area because of the heightened physical and mental fitness required of many positions such as fire, police, and public works.

Patti Mehler will provide an overview of how and when an employer can and should assess an employee’s fitness for duty and some of the options for verifying a covered disability potentially triggering the accommodation obligation.
