Increasingly, wage and hour lawsuits are focused on employers’ treatment of tips, services charges, bonuses, incentives, and commissions.  The wage and hour rules surrounding these types of payments are tricky.  The consequences of tripping up can be dire.  Multi-million dollar settlements - with hundreds of thousands of dollars in attorneys’ fees - are not uncommon.  The Department of Labor’s continued focus on the hospitality industry will only increase the likelihood that your practices will come under scrutiny.

Understanding your obligations under the law is the first step toward ensuring compliance with the complex wage and hour rules.  During this briefing, we will discuss:

  • Tip Pooling:  who's in, who's out, and what is the employer's role.
  • Service Charges:  when a standard service charge helps keep you in compliance....and when it doesn't.
  • Overtime rates:  how to calculate regular and overtime rates for employees receiving gratuities or service charges and the formula that will put you on the right path (a.k.a. the yellow brick road).
