Recently, state and federal government enforcement agencies have focused their enforcement agendas and valuable training and investigative resources on auditing companies' independent contractor classification practices.  Additional fiscal resources, investigative personnel, and information sharing between states and federal agencies will increase the likelihood of your workers being subjected to scrutiny under the applicable federal and state tests for independent contractor status.  As part of this initiative, federal agencies have coordinated their resources with resources from the 50 states to develop best auditing practices.  For example, earlier this year, the U.S. Departments of Labor and Treasury announced a joint task force to address the misclassification issue.

Join Seyfarth Shaw attorneys Camille Olson and Alex Passantino as they discuss:

  • Agency worker misclassification audits and enforcement activities;
  • Relevant documents and information to review now in a pre-audit environment to assess your company's legal compliance with applicable standards; and
  • The most effective strategies for dealing with the IRS, DOL, state workers' compensation boards, and state unemployment benefits agencies.

This webinar is our second in a series focusing on independent contractors.  In the coming months, we will host more webinars on specific topics relating to independent contractors, including complex litigation involving independent contractors; EEO, immigration, and benefits issues and other areas of concern regarding independent contractors; and more.  Please save the dates for our next two webinars in the series.  They will be on September 13, 2010 and
November 16, 2010.
