Litigation Department chair Katherine E. Perrelli will be a panelist at the Boston Bar Association’s 10th Annual Trade Secrets and Non-Compete Symposium on Wednesday, September 12, 2018. Since 2009, the BBA has hosted this symposium bringing together drafters, sponsors, supporters and critics of state bills to reform the use of employee non-compete agreements (ENCAs) and, separately, alternatively or complementarily, to enact the Uniform Trade Secrets Act (UTSA).

After a decade in gestation, new M.G.L. c. 149 § 24L – with important protections and guidance for employers and employees in widely-used non-compete agreements (NCAs) between them – was passed unanimously by the General Court, was signed into law by Governor Baker on August 10, 2018, and will be effective October 1, 2018.  Enacted with it were M.G.L. c. 93 §§ 42-42G, the Uniform Trade Secrets Act, enacted in 48 other States, “tweaked” by the first intellectual property law committee of the BBA in 1992-94 and introduced in every General Court since.

Ms. Perrelli will be joined by the legislators who sponsored the legislation and the experts who helped draft it.

Specifically the panel will cover:

  • the new legal landscape for NCAs and protection of employer confidential information
  • open issues (e.g., operation of “garden leave”), legislative history and future resolution
  • strategies and best practices
