The list of HIPAA penalties assessed by HHS’s Office for Civil Rights (“OCR”) continues to grow.  In recent months, OCR has assessed penalties—running into several million dollars in a number of  cases—for a myriad of violations  These include unauthorized disclosures of protected health information,  untimely breach notices, and deficient risk analyses and risk mitigation plans and processes.   It is indeed risk analysis and risk mitigation failures that dollar for dollar create the most exposure of health care providers and institutions.
