On August 27, 2018, the U.S. Department of Labor’s Wage & Hour Division (WHD) announced a series of public “listening sessions” to gather views on the Part 541 regulation implementing the FLSA’s white collar exemption for executive, administrative, and professional employees.  The listening sessions are intended to provide an opportunity for the public to provide input on issues related to exemption, including the appropriate salary level.  WHD’s current plans are for a new proposed rule (presumably with a new proposed salary level) to be published in January 2019.

As we did in response to WHD’s 2015 proposal to increase the salary level and WHD’s 2017 request for information, Seyfarth Shaw’s Wage & Hour Litigation Practice Group plans to provide its input to WHD and attend each of the five listening sessions.  The sessions will be held on September 7, 11, 13, 14, and 24 in Atlanta, Seattle, Kansas City (MO), Denver, and Providence.

Following the Atlanta session, on September 7, 2018, at 3:00 pm, the Wage & Hour Litigation Practice Group, in conjunction with the Firm’s Government Relations Practice Group, will be hosting a discussion on the long-running saga of the Part 541 rulemaking, including what we can expect from the “listening sessions” and what WHD plans for a proposed rule.
