Scott Carlson and Jay Carle to Participate in “The Exchange” eDiscovery: Chicago

On June 12, Jay Carle will participate in two sessions. Session 2: 21st Century IG v. Defensible Disposition will cover data management processes, artificial intelligence, machine learning and natural language processing. There will also be a focus on best practices on defensibly disposing of data with preservation obligations.
 
Jay will also participate in Session 4: “Preservation, Proportionality and Avoiding Spoliation”. This session will cover legal hold developments, proportionality, and developments in the discovery of information in the possession of third parties, including employee cell phones and personal accounts. 
 
On June 13, Scott Carlson will participate in Session #8: “Spoliation”. This session will cover developments in how courts analyze spoliation issues under FRCP 37 and under the courts’ “inherent authority” to sanction, including a discussion what constitutes reasonable steps to preserve, curative measures, culpability, and how courts determine the severity of sanctions for spoliation.
