"EEOC Says Ruling Validates Its Investigation Tactics"

Seyfarth Shaw Labor & Employment partner Gerald Maatman was quoted recently in a Law360 article on a recent EEOC win the agency claims validates its controversial investigation methods.
 
The Northern District of Illinois allowed to go forward the claims of 17 people the EEOC hadn't identified before it brought a suit against United Road Towing for violations under the ADA. Other courts have recently cited the tactic when dismissing similar claims that were discovered only after the filing of a suit.
 
“This case is the first one in a while to go this way, so the EEOC is using it as a poster child and saying, 'Here is a case endorsing the way we go about litigating, so the critiques that have come our way from other courts are unfounded,'” Jerry told Law360.
 
If different courts continue to reach different conclusions about the EEOC's pre-suit obligations, it could lead to the Supreme Court taking up the matter.
 
“Stay tuned,” Jerry said. “These issues are not going away.”
