Tom is Co-Chair of Seyfarth's Biometric Compliance & Litigation Group and focuses his practice on labor and employment class action defense. Tom’s robust experience representing employers in traditional labor and employment litigation, as well as cutting-edge data privacy matters, provide an ideal platform to serve his clients facing a broad range of litigation, including defending employers throughout the US in biometric privacy class actions, complex employment discrimination class actions, EEOC pattern-or-practice lawsuits, wage-and-hour class and collective actions, TCPA class actions, and single-plaintiff actions for wrongful termination and discrimination.

As Co-Chair of Seyfarth’s Biometric Compliance & Litigation Group, Tom has been on the forefront of biometric privacy issues—an exploding and cutting edge area—since of the beginning and has a deep knowledge on biometric privacy laws. As a result, Seyfarth has emerged as the go-to for professionals in defense of biometric privacy class actions which has a extensive bench of class action defense attorneys who have experience litigating biometric privacy class actions.

Tom has personally represented over 25 companies in biometric privacy class actions spanning a wide range of industries including hotels, airlines, and health care systems which involve bet-the-company damages. Tom has researched and developed comprehensive defense strategies and crafted a winning approach to limit these types of claims, scored a landmark decision in the United States Court of Appeals for the Seventh Circuit on behalf of a Fortune 500 client, obtained case dismissals, and negotiated favorable resolutions on behalf of clients in bet-the-company cases.

Tom also regularly advises various clients, across many industries, on employment and workplace privacy laws, and helps them proactively address issues raised by employment and privacy laws through counseling and compliance efforts. Tom is also a thought leader, frequent presenter, author, and blogger on employment and workplace privacy issues and presents on these topics nationwide.

Tom has a unique perspective to the defense of class actions as a former class action plaintiff lawyer and his experience on both sides of the aisle in class action litigation provides him with the ability to see all sides of a case and to anticipate and defeat plaintiffs’ counsel’s strategies—regarding class certification, motions to dismiss/dispositive motions, and settlement negotiations—before they happen, to help achieve the best possible results for his clients.
