“Effective preparation for trial means marshalling the evidence early on, driving home the theme of the case, and capitalizing on opportunities when they arise—we begin that preparation the day we are retained.”

More About Bill

For more than 35 years as a nationally recognized commercial litigator, Bill has tried franchise, antitrust, and distribution cases for blue-chip companies in many venues across the country. He has appeared before federal district and appellate courts, state supreme courts, federal and state agencies, and various arbitration panels. Bill is best known for his successful litigation of product distribution disputes—typically on behalf of manufacturers—with their vendors, distributors and dealers.

Clients appreciate Bill’s inclusive, team-oriented approach to case management and preparation, one that includes key client personnel, in-house counsel, staff, and expert witnesses—each with well-defined tasks that lead to a clearly defined presentation for trial. In Bill’s view, this team approach gives clients a competitive advantage over opponents and more transparency for client executives, decision-makers, and stakeholders.

Apart from his trial work, Bill spends much of his time on litigation-avoidance counseling, particularly in the areas of antitrust and product distribution. This counseling includes the development and presentation of antitrust compliance programs for clients, and the evaluation of competitive mergers and acquisitions subject to scrutiny by the Justice Department or Federal Trade Commission.

Bill’s success and reputation have received recognition from many of the country’s leading attorney rating services. He has been designated a “Litigation Star” by Euromoney magazine’s Benchmark Litigation Guide in each of its 2018, 2019 and 2020 editions. U.S. News’ Best Lawyers in America (Woodward/White Inc.) has recognized him for more than a decade and selected him as a “Lawyer of the Year” in 2018 and 2020, highlighting Bill’s “high caliber work in the practice areas of franchise law and litigation—antitrust.” He has been listed in “Super Lawyers” (Thomson Reuters) (2004, 2009-2019) for antitrust litigation, and is a “Band 1” ranked lawyer for antitrust in Chambers USA (2015-2019), which describes Bill as “a seasoned antitrust practitioner with a focus on litigation [who] has one of the leading franchising and dealer practices in the country and represents a who's who of the largest automotive firms.”

What Bill enjoys most about his practice is the opportunity to learn about clients’ operations and challenges. In his words: “I think the best business litigators are those who take the time to understand the client’s business so well that they can effectively teach it—in the context of the dispute at hand—to a judge, jury, or other decision-maker.”
