This presentation will cover independent contractor misclassification and joint employment issues. We will discuss the many different tests for determining if a worker is properly classified as an independent contractor, best practices and practical tips for avoiding liability, and the wide-ranging implications of misclassification, including severe penalties under the newly enacted Labor Code section 226.8. We will also discuss joint employment theories, such as when a worker seeks to hold multiple entities liable as his or her employer or uses the joint employer theory to expand the scope of a class action to include workers at several related entities. The presentation will also address joint defense agreements, indemnification, trade secrets, and other litigation issues that may arise in these types of cases.
