“Knowing Your Delinquent Neighbors”

Alan Kazlow was quoted in the real estate Q&A column of The New York Times on Sunday, November 22, 2009. The letter writer wanted to know if it is legal for his condominium to circulate a list of all owners who are delinquent in paying common charges.

Alan responded that circulating the names of delinquent owners among the members of the condo association would not be "illegal," and might be permitted by the association's bylaws of rules and regulations. Alan noted, "A court also would most probably defer to the board under the business judgment rule in adopting such a new rule and regulation.” He pointed out, however, that publishing the name of an owner who subsequently proves that he was not delinquent could expose the board to liability in a civil action.
