“Liebman’s National Labor Relations Board Legacy”

An article by Labor and Employment partner Kenneth Dolin was published in the October 17 issue of The National Law Journal. In the article, Ken describes the impact of Wilma Liebman’s tenure on the National Labor Relations Board (NLRB). Liebman served on the board for nearly 14 years, and President Obama appointed her as chairwoman in January 2009. She left the NLRB after her third term ended on August 27.

According to Ken, Liebman was “an ardent supporter of unions and critic of the Bush board.” Ken summarized her influence on the NLRB, stating “the Liebman board reversed Bush board precedent and returned to Clinton-era precedent in many areas. However, it also fashioned new rules that are unprecedented and were sought without any attempt to identify particular problems for which the status quo has failed. …The board sought to further the interests of employee organizing and unions at the expense of employee free choice and the right of employers to engage in legitimate free speech.”
