Why High Court Should Take Cheerleader Uniform Case” on November 24 in Law360 on why the Supreme Court should grant certiorari on the issue of how to assess the copyrightability of functional designs. Maluf writes that the Supreme Court will have an opportunity to adopt a harmonized approach to separability and copyrightability in connection with fashion-related works.
