Agenda:

Registration and Breakfast
8:00 a.m. to 8:30 a.m.

Program
8:30 a.m. to 10:00 a.m.

With the Obama Administration’s focus on enforcement of employment laws relating to the hiring process, and the corresponding uptick in private actions, employers need to take a closer look at their hiring practices.  While employers need to minimize their legal risks, they also have a pressing need to ensure that applicants satisfy their legitimate requirements.  Once these competing concerns are understood and accounted for, employers can begin to strike the right balance.

Please join Seyfarth Shaw for a breakfast briefing designed to help employers mitigate risk while still meeting their business objectives.  This program will explore:

  • The EEOC’s commitment to investigating hiring practices, including the issuance of broad subpoenas seeking nationwide information;
  • The surge of government enforcement actions alleging disparate impact and disparate treatment discrimination based on hiring practices;
  • Recent and proposed legislation restricting the use of credit history in hiring and other employment decisions (e.g., the Equal Employment for All Act);
  • Understanding the Fair Credit Reporting Act and state laws, and developing best practices for conducting background checks; and
  • Limitations on pre-employment testing.
