Seyfarth’s Zachary Jacobson and Sarah Barney co-authored an article, “Contract Disputes Recap: Facts Differ But Same Rules Apply,” in Law360 on March 26. The Seyfarth attorneys discussed two decisions that illustrate how the boards and courts have applied existing principles to new situations in a manner that may challenge old assumptions.

“Contractors and contracting officers should not assume that commercial terms and conditions will not apply to task order performance under an FSS contract. Unless addressed before a contract award, disputes over applicability will ultimately fall to the tribunal to resolve.”
