Webinar Recording: Terminations and Settlements After Reuter, How to Avoid Paying Thrice
About the Program
On April 4, 2022, the Massachusetts Supreme Judicial Court adopted an extremely stringent interpretation of the Wage Act that mandates treble damages for all late payments of wages in the Bay State, including those resulting from honest mistakes and errors that are promptly fixed.
In Part 1 of this micro-series, we examined what employers in Massachusetts could - and should - do to insulate their commission and incentive compensation plans from Wage Act claims in light of the Reuter decision. In Part 2, we will take a deeper look at how Reuter impacts the payment of wages to a departing employee, both at the time of termination (or resignation) and if the employee threatens litigation after termination concerning allegedly unpaid wages. While the Reuter decision leaves no wiggle room for mistakes in the process, there may be things an employer can do proactively to ensure that they have the time they need to timely pay all wages due under the Commonwealth’s wage laws.
Specific topics covered include:
- Wages that an employer must pay to a Massachusetts employee at the time of termination;
- Suggestions for how to handle unplanned terminations and/or unexpected resignations relative to any wage payments due; and
- Potential pitfalls and recommended strategies for settling threatened and/or pending wage claims in light of Reuter.
