"Hiring foreign workers proves more time-consuming, costly"

Seyfarth Shaw Immigration partner Angelo Paparelli was quoted in the Daily Journal on October 14. The article discussed a drop in immigration legal work due to the decline in hiring of foreign workers. Deterrent factors, such as the cost of visa applications and their approval requirements, have made employers less willing to take the necessary steps to employ these workers.

"The burden of demands made by the government for these visas is growing," said Angelo. They consist of the request for evidence, which includes more documentation or clarification; the notice of intention to deny, which requires applicants to provide reasons to prevent rejection of the visa request; and the notice to revoke, which allows the immigration service to rescind an issued visa.

Angelo commented that "The typical work that these employment-based lawyers provided and earned a living on just isn't there for them anymore." He says that now, immigration lawyers have done more work in three areas of law—defense concerning complaints against the H-1B application process, assisting with I-9 forms and the EB-5 visa program, which allows foreigners to obtain visas in exchange for investing in U.S. companies.
