On December 3rd, Seattle Partner Ashley Sherwood will be a panelist at the Construction Super Conference 2026. The conference offers educational sessions and panel discussions to address issues within the legal, business, and economic realms of today’s construction industry. Ashley will be presenting on “Built One Way, Recorded Another: The Growing Disconnect in Construction Claims” with Sean Dillon (Dillon ADR), Tyler Smith (Barnard), Catherine Swan (Clayco) and Avi Sharma (Delta Consulting).

Participants will learn how to:

  • Identify common reasons project records fail to establish clear causation and quantifiable impacts in disruption claims.
  • Compare how contractors, counsel, experts, and triers of fact evaluate the same project records when presenting, defending, and deciding claims.
  • Implement practical risk mitigation strategies—during and after construction—to address documentation gaps and improve the ability to prove or challenge entitlement and quantum.

Drawing on the perspectives of contractor in-house counsel, outside counsel, delay and damages experts, and a trier of fact, this panel will explore how documentation gaps develop, how different stakeholders interpret the same records, and what types of evidence ultimately carry weight when disruption and damages are evaluated. The panel will also explore whether AI will help reduce this gap.
