Atlanta’s Erika Birg Quoted in the Atlanta Journal Constitution and the Fulton County Daily Report
“Amendment on Ballot Would Strengthen Non-Compete Agreements”; “Get Ready to Examine Employee Contracts”
Litigation Partner Erika Birg was recently interviewed by two Atlanta newspapers about the impact of a ballot referendum that would give employers in Georgia greater power to enforce non-compete agreements against former employees who had access to sensitive information such as trade secrets. The proposed constitutional amendment asks voters to give the Legislature the power to pass such laws.
Erika told the Atlanta Journal Constitution October 25 that Georgia courts have been historically unfair to companies with such agreements. She told the Fulton County Daily Report October 28 that the measure is essential to providing clarity to employers and their attorneys on how to draft non-compete provisions in contracts. Erika added that a 1991 state supreme court decision had muddled the law on what types of agreements are enforceable.
“I have lawyer friends who have said they're in fear when a client asks them to write a non-compete," Erika told the Fulton County Daily Report. "Everyone has employees, and small businesses don't need to be hiring a specialist to address these issues."
