Charles Walters Quoted in Daily Labor Report “Alternative Dispute Resolution: Conference Panelists Halt Benefits of EEOC Mediation for Private Sector”

Charles Walters’ comments as a panelist at the October 1, 2007 District of Columbia Bar program were quoted in the article “Alternative Dispute Resolution: Conference Panelists Halt Benefits of EEOC Mediation for Private Sector,” published in the October 4, 2007 issue of Daily Labor Report. Charles notes that “the EEOC mediation process is an excellent one, and one that I have had great experiences with." He also offers several tips for making the best use of EEOC's mediation process, noting that preparation and flexibility are two essential components.

 


Charles further notes the importance of being creative during mediation sessions, especially to avoid conflicts that might become barriers to settlement. He suggests that counsel bring electronic skeleton versions of confidentiality clauses and other provisions that the client may want included in any settlement agreement that could come out of the mediation settlement. Charles also advises that if the client refuses to give his counsel a reasonable settlement authorization beforehand, counsel should have someone from the company with the authority to settle on its behalf during the course of the session available.
