“Why All Counsel Should Understand Judicial Estoppel”

Seyfarth Shaw Bankruptcy and Commercial Litigation attorney Christal A. Delgado wrote an article published in the July 2012 issue of For the Defense. The article discussed the doctrine of judicial estoppel as it relates to bankruptcy and specific judicial estoppel scenarios, including the application of judicial estoppel when the debtor plaintiff’s bankruptcy is dismissed and when a claim is undervalued.

“Chances are good that at some point in your legal career, you will defend a client against an opposing party plaintiff that filed bankruptcy after the cause of action against your client accrued," Christal wrote. "If the opposing party plaintiff failed to disclose the cause of action against your client properly you should raise the doctrine of judicial estoppel to relieve your client of total liability or to reduce significantly the amount of potential damages.”
