Christopher Robertson Quoted in Agenda "Questions Hinder Full SEC Exec Comp Enforcement"
Christopher Robertson was quoted in the August 4, 2008 issue of Agenda in the article, "Questions Hinder Full SEC Exec Comp Enforcement." The article discussed the SEC's recently published Q&A session aimed at clearing up confusion concerning key issues regarding executive compensation enforcement.
Chris offered his opinion on the confusion, as he explained, "It doesn't surprise me, given the length of the regulations... This was a significant revision of disclosure rules. The SEC understood that it was going to take time to fully put the regulations into force."
As the former senior counsel in the SEC's Division of Enforcement, Chris' in-depth knowledge was also highlighted in a sidebar of the article that discussed the growing speculation over how a test case of enforcement may arise. Chris suggested that "The SEC would look for the most deliberate attempt to avoid disclosure. The facts will drive which [company or area of business] produces a test case." The article noted that political pressures from shareholders, the general public or Congress may determine the actual enforcement action. As Chris concluded, "The first test case will be driven by the fact that a particular abuse is so egregious."
